Civil Liability - Essay Example Without an adequately stated cause of action the plaintiff's case can be dismissed at the outset. It is not sufficient merely to state that certain events occurred that entitle the plaintiff to relief. All the elements of each cause of action must be detailed in the complaint. The claims must be supported by the facts, the law, and a conclusion that flows from the application of the law to those facts.2 To prove a cause of action for negligence, you need to prove the four elements of the tort. The four elements of a tort are the following: a) the existence of a legal duty owed by a person to others which is usually provided by common or statutory laws; b) the breach of the duty by one person (or the negligence itself); c) the breach of the duty being the proximate cause of damages suffered by a person; and, d) damages incurred by a person. In a car accident for example, you need to prove the following to hold the driver who caused the crash liable for negligence; a duty to operate the vehicle properly, that they breached that duty by driving improperly, that the breach of the duty by the offending driver caused the accident; and, that the person was damaged by the accident, in the form of injuries.3 In general, a party who has caused an injury or loss to another as a consequence of his negligence is responsible for all the consequences.4 The usual penalty for negligence is the payment of damages. Damages, in a legal sense, are the sum of money the law imposes for a breach of some duty or violation of some right.5 It place a monetary value on harm done following the principle of restitution in interim (Lain term for "restoration to the original condition. Thus, for most purposes connected with the quantification of damages, the degree of culpability in the breach of the duty is irrelevant. Once the breach of duty is established, the only requirement is to compensate the victim. One main test that is posed when deliberating whether a defendant is entitled for damages is the "reasonable person" test. This answers the question: would a reasonable person (to be determined by a judge or a jury) be damaged by the breach of duty This test is important in deciding whether or not a defen dant is entitled to compensation for negligence or tort. Generally, there are two types of damages: compensatory and punitive. The term "damages" typically includes categories, but the term "actual damages" is synonymous with compensatory damages, and excludes punitive damages. Compensatory damages, like the name suggests, are intended to compensate the injured party for his loss or injury. This may include past and future economic losses, including medical expenses and loss of wages, and general damages such as such as pain, suffering, and mental anguish.6 Each of the four elements of a tort typically must be present to be compensated. Slip and Fall Accident A typical source of cause of action because of negligence in the United Kingdom is the slip and fall accident. This happens when a person slips and falls over a private or public property because of the wet, rough, or oily floor or due to the dangerous condition of the place that resulted to injury. The two passages are related because both are explaining the relationship between Mr. and Mrs. Oke is also very mysterious. Biblical Foundations Essay Curriculum development is establishing a plan of what a school is going to teach during a school year. The time frame of the curriculum can vary from a quarter to a semester to even being taught the entire school year. Wayne (2010) suggests that each individualââ¬â¢s personal biblical worldview impacts each person in their beliefs and opinions about curriculum development differently. The stance taken by this individual is that of trying to see things in the manner that God would want. God is all knowing and being all knowing, He knows what is best in all things at all times. The Bible says: ââ¬Å"For by him all things were created: things in heaven and on earth, visible and invisible, whether thrones or powers or rulers or authorities; all things were created by him and for him. He is before all things, and in him all things hold togetherâ⬠(Colossians 1:16-17). Developing a curriculum is not to be taken lightly. Prayer, studying the word of God, and meditation must all be a part of the development. The role of teachers is to not only teach our students the curriculum that is set before them but to be a leader and a role model. Being a role model is a scary concept. Scary because it means that one is to not just use the words that they speak but they are to show it by the way they act and live their life. Christian teachers have a tremendous job to accomplish. They influence not only the other teachers around them but also the students that they are around every day. The curriculum that is being taught is of the utmost importance but the Christian witness that is being shown is of even more importance. The public school system does not make this easy for those who are Christians. Speaking the word of God is prohibited within this setting. Knowing this, as Christian teachers, being a deliberate Christian role model is of the utmost importance. Many might say that this is impossible but that is far from the truth. The Bible says: ââ¬Å"With man this is impossible, but with God all things are possibleâ⬠(Matthew 19:26). The Bible also says: ââ¬Å"â⬠¦Everything is possible for him who believesâ⬠(Mark 9:23). Teachers are some of the most innovative and creative people. Christian teachers are to use this to their benefit. The God we serve is the one and only living God and through him, all things are possible. This makes the possibilities of being a good Christian role model limitless. The role of the learner today should be one of wanting to learn. Teachers can encourage this by using student-centered learning according to Blumberg (2008). This can be a very powerful way of getting the learner to want to learn. Student-centered learning does not have to be the entire focus of the class. The focus here could be put into place after the teacher has instructed the students. In a ninety minute class, the teacher is more than able to instruct the students, and then put them in student-centered learning. This helps the learner to focus on what they have learned and not on what the teacher is teaching according to Blumberg (2008). The approach here helps the learner to focus on what they need to be doing and less time on what is going on around them. In our society today, the biblical worldview is quickly being taken away while the modern worldview is silently creeping in to the minds of everyone. Scripture tells us: ââ¬Å"â⬠¦Satan himself masquerades as an angel of lightâ⬠(2 Corinthians 11:14). We, as Christians, are becoming so conditioned to being politically correct that we are forgetting what is biblically correct. We sit back and think that if we just ignore what is going on, then it will just go away. Instead of that, things have gotten worse and even our young children and adults are beginning to believe that what is taking place is alright. No prayer in school, it is the holiday break not Christmas break, it is spring break not Easter. A worldview is what we develop because of what is going on around us. Many do not even realize that their worldview is being formed or altered. When asked what their worldview is, many cannot even explain it, let alone tell you where their view came from. Todayââ¬â¢s Christian society needs to step up and take a stance on what needs to be taught within our public schools. Many in our Christian society have pulled their children out of the public school system to either put them into private Christian schools or to homeschool them. Although this is not wrong, it is not accurate either. The government of today has been shaped and is being shaped by the beliefs of many different religions. ââ¬Å"The U. S. was the first western nation to be founded predominately by Protestants ââ¬â not Roman Catholics. That fact alone expresses Americaââ¬â¢s willingness to experiment with the novel and a defiance of tradition. Its history includes the emergence of utopian experiments, religious fanaticism, and opening the door to such exotic religions as Buddhism, Hinduism, Islam, and Taoism. Such has been the winding road of religious evolution in Americaâ⬠(History of Religion in America). In trying to make the United States a place of religious freedom, our government has instead made the life of a Christian more difficult. The governmentââ¬â¢s role in our society should be that of making sure that our children are educated to the standard possible. Although religious viewpoints should be left up to the families of the children, the government still needs to maintain that our freedom is not taken away within the schools. There does need to be guidelines that need to be established but without the persecution of believers of Christ. The church needs to be very careful when getting involved with curriculum development outside of Christian schools. There are so many beliefs that are out there that if the church were to get too involved, the government could and has stepped in to tell us that all has to be taught or expressed. This is where the parents need to step up to the plate. Parents can become and should become a part of the school. Becoming a part of the Parent Teacher Organization is a good start. Getting to know the teachers and expressing to them the needs that should be better met for the students should be of the utmost important. Parents have the right to have a say in the development of the school curriculum. Done in the proper manner, parents can even have a powerful impact on the curriculum their children are taught. Being a part of the process instead of being a part of the problem is the best plan any parent should be a part of for their child. Teachers, learners, society, government, church and family all have an important role in developing curriculum. Each on has a specific role that affects each and every one of us. Teachers and learners work together every day. They get to know each other on a level that can and should encourage trust with one another. Society and government go hand in hand in expressing what the people of that particular area want. Church and families hold the values we want our children to have as well as the standards of life we want. The development of curriculum is to be held to a high standard. Each group that is listed above help to provide the high standard that our children deserve in the educational field.

Modernism and Postmodernism in Architecture INTRODUCTION CONTEXT OF MODERNISM Modernism is a set of cultural or aesthetic styles which associates with the scientific and the artistic movement which started in the decade around the First World War and have dominated among several movement such as cubism, functionalism and surrealism. However in architecture, modernism reacts to the dedication of addressing new buildings after the two World Wars such as mass housing of traditional forms and the potential for exploring new conditions of production such as new materials and technology. Le Corbusier and Mies van der Roche were the key influences of modern architecture; they took several cultures and tradition to formulate the notion of modern architecture. Curtis, W. J.R. (2001). Modernist have the idea that architecture should have a result as being functionalistic, positivistic, technocentric, and rationalistic with their building or urban planning. Harvey, D. (1990) page 35. In the World War II, Modernism became popular especially in the United State where it took on a new life by using different technologies such as steel frame and glass curtain walls for constructing skyscrapers and suburban office parks and shopping centers which were cost-effective. Ghirardo, D. (1996). CONTEXT OF POSTMODERNISM Postmodernism is very ambiguous to describe because it has certain elements that relates to modernism. The term originated within artists and critics in the United State in the 1960s and it was distributed in the European and other industrial nations in the 1970s. However postmodernism is an unstable concept of movement within an advance capitalist culture that argue the visual approaches in literary criticism of art, film, fashion and architecture within the political economic social conditions of the late 20th century. It also involves the new relationship between humankind and nature. Ghirardo, D. (1996). Postmodern notion of approaches to architecture derived from modernism ideology of architecture, and it even influences some postmodern architects, this is because of their knowledge from training and also their modern methods of constructions but they also add their new concept to their buildings. Likewise Charles Jenks explores further the idea of the modernist idea within postmodernism architecture, he argues that postmodern architecture is double coded, this suggest that postmodernism is an eclectic mixture of traditional codes with modern ones this shows that modernism is always one of the codes that forms postmodernism so postmodern architecture has evolve from modernism but it must go beyond modern style. Therefore postmodernism is to break completely or drop modernist idea of architecture but has extended it into a different notion. Jenks explores Mies van de Roche who is a modern architect, he argues that the use of steel I- beams for buildings are nasty and brutal and has no purpose for its users or developers so therefore postmodernism has evolve to find solution of improving the upon modernism. The indication that modernism architecture is rational and austere is because the restrictions and their influence on traditional forms and concepts which most postmodern architects see as passà ©, however when postmodern architect design they contravene to tradition also when they build their buildings they express it through a modern way by emphasising on a mixture of different styles. THE PORTLAND PUBLIC SERVICES BUILDING The Portland building (see figure 4) was a very significant municipal building within its era, which was begun in 1980 in Portland Oregon, this project provoked modernist architects because it was one of the most inspirational building in postmodernism. The public building is located in the middle of the area whereby it had to have a quality of postmodern landmark, but however his way out was to bring back figural forms to the building to portray the public nature of the context and urban and the internal program. japanese-American During WWII By: Japanese immigrants and the following generations had to endure discrimination, racism, and prejudice from white Americans. They were first viewed as economic competition. The Japanese Americans were then forced into internment camps simply because of the whites fear and paranoia. The Japanese first began to immigrate to the United States in 1868. At first they came in small numbers. US Census records show only 55 in 1870 and 2,039 in 1890. After that, they came in much greater numbers, reaching 24,000 in 1900, 72,000 in 1910, and 111,000 in 1920.(Parrillo,287) Most settled in the western states.(Klimova,1) Many families in Japan followed the practice of primogeniture, which is when the eldest son inherits the entire estate. This was a ââ¬Å"pushâ⬠factor. Because of primogeniture, ââ¬Å"second and third sons came to the United States to seek their fortunes.â⬠(Parrillo,287) The promise of economic prosperity and the hope for a better lif e for their children were two ââ¬Å"pullâ⬠factors. These foreign-born Japanese were known as Issei (first generation). They filled a variety of unskilled jobs in railroads, farming, fishing, and domestic services. (Klimova,1) The Japanese encountered hostility and discrimination from the start. In California, a conflict with organized labor was due to their growing numbers in small areas and racial visibility.(Parrillo,287) White workers perceived Japanese as economic competition. Their willingness to work for lower wages and under poor conditions brought on hostility from union members. The immigrants became victims of ethnoviolence. In 1890, Japanese cobblers were attacked by members of the shoe makerââ¬â¢s union, and Japanese restaurateurs were attacked by members of the union for cooks and waiters in 1892. It was very difficult to find steady employment; therefore, most of them entered agricultural work. They first worked as laborers, accumulated sufficient capitol, th en as tenant farmers or small landholders. Some became contract gardeners for whites.(Parrillo,287) The Japanese farmers were very knowledgeable of cultivation, which made them strong competitors against white farmers. More discrimination by the dominant group soon followed. ââ¬Å"In 1913, the California legislator passed the first alien landholding law, prohibiting any person who was ineligible for citizenship from owning land in the state, and per... ...omic exploitation. Long Island Nuclear The question of whether Long Island should have nuclear power plants is controversial. There are two sides that can be taken; however, both sides have their own share of problems. If we were to chose not to have nuclear plants, then eventually all natural resources will run out. Oil supplies as of right now will run out in two hundred years. But that is if we keep on using the same amount of oil that is consumed today. Our use of oil is certainly not being diminished; in fact each year the amount of oil used goes up. So oil supplies probably wonââ¬â¢t even last that long. The natural resources that we use now are still harmful to the earth. The gasoline that we use to run our cars pollutes the air, and considering the amount of cars that are driven each day on the expressway. That is a lot of barrels of oil. However, if Long Island decided to use nuclear energy, then there is a great danger of toxic waste invading our drinking water, and also the chance of a spill similar to Chernobyl or Three Mile Island. As we saw with Chernobyl there is great danger when using nuclear energy. If this were to happen on Long Island the risk of mortality would be even worse. There is no place on Long Island that is a good spot with no inhabitance. On Long Island there would be no escape, the roads simply would not support that amount of traffic. These are the fears of Long Islanders. Which brings us to another question. What did Long Islanders know about the Shoreham Nuclear Power Plant? LILCO (long island lighting company) first announced its plan to build a nuclear power plant in 1965. They bought 455-acres in Shoreham, Wading River, and started construction in 1968. (pg 16 Aron) The plant was engineered and built by Stone & Webster Engineering Corp. They have helped ten prior electric companies, to build nuclear plants before 1985. Long Islanders at first were for having cheap energy, and did not disagree with the construction. But as time past and politics changed.
